

Representative Andy Biggs (R-AZ) is taking a stand for constitutional integrity by filing a resolution to remove U.S. District Court Judge James E. Boasberg. This bold move bypasses the traditional two-thirds Senate vote, holding Boasberg accountable for not upholding the “good behavior” clause of the Constitution.
This resolution, proposed in the House of Representatives, accuses Judge Boasberg—Chief Judge of the powerful U.S. District Court for D.C.—of abusing his position and interfering with President Donald Trump’s rightful authority. The focus is on Judge Boasberg’s actions against the deportation of Venezuela’s Tren de Aragua gang members, a move authorized by Trump under the Alien Enemies Act for national security.
On March 15, 2025, President Trump invoked the historic 1798 law to deport these dangerous individuals, citing the threats they pose to public safety. Instead of supporting this necessary action for homeland security, Boasberg blocked the deportations, undermining the President’s constitutional duty to protect America.
The resolution also questions Boasberg’s previous conduct as a FISA court judge, alleging misuse of discretion and failure to disclose outside payments. Rep. Biggs sees these actions as further evidence of Boasberg’s unfitness for the bench.
“James E. Boasberg knowingly extended beyond the bounds of power of his office and unjustly interfered in the execution of foreign policy and national security for partisan purposes of halting the implementation of the President’s foreign policy and for political gain,” according to the resolution.
Additionally, the resolution points out Boasberg’s failure to disclose payments from non-federal sources and his misuse of discretion during his FISA court tenure.
Rep. Biggs plans to bypass the cumbersome impeachment process—traditionally requiring a two-thirds Senate vote—by invoking Congress’s inherent authority under Article III, Section 1 of the Constitution. This move is a shot across the bow at activist judges overstepping their bounds against a duly-elected President like Donald Trump.
“We cannot stand by while activist judges who incorrectly believe they have more authority than the duly-elected President of the United States, impose their own political agenda on the American people,” said Congressman Biggs.
Biggs has previously supported resolutions to impeach Boasberg, but he’s well aware that such measures get blocked by Democrats in the Senate. His new resolution asserts that rogue judges can be removed by a simple majority, the same way they are confirmed.
Judge Boasberg’s actions, per Rep. Biggs, violate the constitutional Good Behavior Clause, which demands his removal. It’s time for Congress to uphold its promise to defend the President’s authority and the rule of law.
