Republican Texas Rep. Chip Roy introduced legislation Monday to codify President Donald Trump’s border policies into permanent law — preventing future Democratic administrations from reversing the immigration crackdown that drove crossings to record lows.
The Permanent Trump Secure Border Act would make Trump’s asylum and border security reforms legally permanent, Roy’s office told the Daily Caller.
“President Trump’s most successful border security policies remain vulnerable because Congress has failed to codify them into law. If we fail to act now, we risk returning to the chaos and crisis we saw under President Biden the next time Democrats take power.”
Roy aims to attach the package to Republicans’ second reconciliation bill — shielding it from Democratic reversal once the GOP loses control of Congress or the White House.
The legislation mirrors H.R. 2, the Secure the Border Act House Republicans passed in May 2023. That bill would have funded new border wall construction, expanded resources for the Department of Homeland Security, and boosted enforcement capacity at Immigration and Customs Enforcement and Customs and Border Protection.
Senate Democrats killed H.R. 2 when they controlled the chamber.
Without permanent codification, Roy’s office warns, Democrats will reverse every Trump border policy the moment they regain power — erasing the administration’s historic enforcement record.
Border crossings hit their lowest level in more than 50 years under Trump’s policies. Hundreds of thousands of illegal aliens were deported while millions more self-deported.
“House Republicans already passed the blueprint in H.R. 2 last Congress. We must pair these critical reforms with Reconciliation 2.0 and finally make border security permanent.”
Roy’s bill comes as Trump’s border enforcement remains legally vulnerable — relying on executive orders that any future president can undo with the stroke of a pen.
