
In a landmark decision, the United States Supreme Court has unanimously ordered the return of Kilmar Abrego Garcia, an alleged member of the notorious MS-13 gang, to the United States. This decision comes after Garcia was deported to a notorious prison in El Salvador due to what has been described as an “administrative error.”

The Supreme Court is requiring the Trump administration to “facilitate” the return of a Maryland man deported last month to a notorious prison in El Salvador due to what officials described as an “administrative error.”
The high court’s decision stands firm against the Trump Administration’s request to overturn a judge’s directive that U.S. officials work towards Garcia’s release and return. This ruling was necessary after Garcia was mistakenly sent to El Salvador despite an immigration court’s order that he remain in the U.S. due to potential threats from local gangs.
The Supreme Court stated that the judge’s directive correctly demands the government to “facilitate” Garcia’s release from El Salvadorian custody, ensuring his case proceeds as it should have, had he not been erroneously deported.
Last week, U.S. District Judge Paula Xinis had mandated the Trump Administration to bring back Garcia, following his deportation to the infamous CECOT prison in El Salvador.
Supreme Court Chief Justice John Roberts initially blocked the order requiring Garcia’s return by the following Monday. President Trump then sought the Supreme Court’s intervention for an emergency stay on Judge Xinis’ order, which Roberts granted, pending a resolution.
However, Garcia’s legal representatives challenged the Supreme Court’s stay, leading to this Thursday’s decision that compels the U.S. to facilitate his return.
For background, in 2019, Garcia was apprehended alongside several MS-13 members who identified him as a high-ranking official within the gang.
