
In a significant victory for patriots across America, the US Supreme Court has vacated orders from Judge James Boasberg that previously blocked the Trump Administration from deporting Venezuelan gang members under the Alien Enemies Act.
Judge Boasberg had initially issued a temporary restraining order (TRO) to halt the deportation of thousands of Venezuelan nationals suspected of being affiliated with the notorious Tren de Aragua (TdA) gang, claiming it was under the Alien Enemies Act.
Leftist groups such as the ACLU and Democracy Forward swiftly moved to a DC court, trying to protect these dangerous illegal aliens from deportation. However, the Supreme Court declared that Boasberg lacked jurisdiction in this matter.
The court did stipulate that the administration must provide reasonable notice to allow gang members an opportunity to challenge their deportations in court.
The decision to vacate Boasberg’s orders was supported by five Supreme Court Justices: Roberts, Gorsuch, Kavanaugh, Thomas, and Alito. Meanwhile, Justices Kagan, Jackson, and Sotomayor dissented, with Justice Amy Coney Barrett dissenting in part.
Justice Kavanaugh, concurring, emphasized, “Importantly, as the Court stresses, the Court’s disagreement with the dissenters is not over whether the detainees receive judicial review of their transfers—all nine Members of the Court agree that judicial review is available. The only question is where that judicial review should occur. That venue question turns on whether these transfer claims belong in habeas corpus proceedings or instead may be brought under the Administrative Procedure Act. I agree with the Court’s analysis that the claims must be brought in habeas.”

While this ruling is a triumph, the fight is far from over. Just last week, Judge Boasberg hinted at holding the Trump Administration in contempt for supposedly violating his order, even though they did not. He threatened to hold Trump officials accountable for allegedly failing to bring some of the world’s most dangerous criminals back to the United States.
President Trump reacted to the Supreme Court’s decision with pride and gratitude. On Truth Social, he declared, “The Supreme Court has upheld the Rule of Law in our Nation by allowing a President, whoever that may be, to be able to secure our Borders, and protect our families and our Country, itself. A GREAT DAY FOR JUSTICE IN AMERICA!”
