Gary Shapley, the courageous IRS whistleblower who boldly uncovered political meddling in the Hunter Biden tax inquiry, is anticipated to be named Acting Commissioner of the IRS, as per a memo reviewed by The Wall Street Journal.
Shapley’s stepping up is timely as former President Donald Trump’s pick for full-time IRS Commissioner, ex-Missouri Congressman Billy Long, waits for Senate confirmation. Melanie Krause, the outgoing commissioner, resigned amidst furor over a data-sharing agreement with ICE, which grants them access to taxpayer details like names and addresses to pinpoint and deport illegal aliens. Krause only learned of this deal post-finalization, voicing her outrage over being excluded.
WSJ reports, “Shapley replaces Melanie Krause, who had been acting commissioner since late February and announced her departure after the Treasury Department and the Department of Homeland Security signed a data-sharing agreement aimed at helping the government find some immigrants suspected of crimes. Krause replaced Douglas O’Donnell, a longtime agency employee who retired in February. O’Donnell replaced Danny Werfel, who resigned on Inauguration Day.”
Gary Shapley has been a pivotal figure, revealing the Hunter Biden financial scandal and the Biden family’s overseas dealings. His whistleblower testimony, extensively covered, unmasked a politically driven cover-up by the DOJ and IRS during the Biden administration.
In July 2023, Shapley testified before Congress, asserting that Biden-appointed U.S. Attorneys in D.C. and California hampered charges against Hunter Biden. He claimed political appointees influenced the DOJ’s decision-making, stifling the case’s progress.
These concerns were echoed by Ziegler, who alleged that Delaware’s US Attorney David Weiss was “constantly hamstrung, limited, and marginalized” by DOJ brass. Shapley’s claims gained traction from his handwritten notes taken during a meeting on October 7, 2022, with Weiss. These notes, unveiled by his lawyers, contradicted FBI agent Thomas Sobocinski’s account, revealing Weiss’s admission of not being the final decision-maker on Hunter Biden’s charges.
Shapley also exposed that Assistant U.S. Attorney Lesley Wolf refused a search warrant for President Joe Biden’s Delaware home, worrying about “optics” despite clear probable cause.
Moreover, he testified that the CIA intervened, stopping the IRS from interviewing Kevin Morris, a close Hunter associate, post a classified CIA briefing.
In a House Oversight Committee hearing, Shapley and fellow whistleblower Joseph Ziegler stood firm in their belief that mentions of “the Big Guy” in Hunter’s communications referred to President Joe Biden.
Reports in May 2024 indicated Shapley and Ziegler faced retaliation from Special Counsel David Weiss, overseeing the Hunter Biden case. Weiss filed a document in March 2024 falsely implying they were under scrutiny for misconduct. Shapley’s lawyers dubbed this a calculated move to tarnish the whistleblowers, with one describing it as “a slap in the face” to their pursuit of transparency.
In March 2025, Treasury Secretary Scott Bessent rightly appointed them to leadership roles within the Treasury Department.

I saw these two fellows before the President’s address to Congress in Speaker Johnson’s office. They came over to me and said, Sir, we’re still being harassed. I had been in touch with Senator Grassley about what was happening to them, but seeing them in person really brought it home for me. I went and decided I would bring them into Treasury, give them a year to investigate the wrongdoing that’s going on at the IRS, and then they will go back in. Mr. Shapley will serve as the Senior Deputy for Investigation and Enforcement.
